
Terms and conditions
Purpose
The purpose of this Agreement is to establish the terms and conditions under which Klein Travel will provide travel-related services to the Client.
Accurate Information
The Client agrees to provide accurate and timely information required for travel bookings. Any errors due to incorrect information provided by the Client are the Client’s responsibility.
Compliance
The Client is responsible for ensuring compliance with all applicable laws, including but not limited to visa and passport requirements.
Payment
The client agrees to make full and timely payments according to the terms outlined.
The Client authorizes Klein Travel to charge the provided credit card for all agreed-upon fees and payments related to the services provided. The client agrees that once a payment is processed, it is binding and final.
Chargebacks
The client expressly agrees not to initiate any chargeback or reversal of payment without prior written notice to Klein Travel and a good faith effort to resolve any issues directly with Klein Travel. Any attempt to initiate a chargeback without providing Klein Travel with an opportunity to resolve the issue first shall constitute a breach of this agreement.
In the event of an unauthorized chargeback or reversal, the Client shall be liable for any and all costs associated with the chargeback including but not limited to the original payment amount, any chargeback fees imposed by the payment processor, legal fees, and any costs incurred by Klein Travel in recovering the funds. The Client further agrees that initiating a chargeback without merit is considered fraud and may result in legal action.
Additionally, if a chargeback is initiated, the Client understands and agrees that Klein Travel may pursue all available legal remedies, including but not limited to reporting the matter to credit bureaus, initiating collection proceedings, and seeking compensation for damages. The client will also be responsible for any attorney fees, court costs, and other expenses incurred by Klein Travel in enforcing this provision.
Cancellations and Refunds
Cancellations initiated by the Client are subject to the terms as outlined in the initial booking via the third-party supplier.
In the event of a force majeure, including but not limited to acts of God, war, pandemics, or other unforeseen events beyond the control of Klein Travel, the Client acknowledges that Klein travel is not liable for any losses or damages and that refunds will be subject to the policies of third-party suppliers.
Supplier Responsibilities
Klein Travel acts as an agent for third-party supplies (e.g., airlines, hotels, tour operators) and is not responsible for their actions, omissions, or service failures.
Klein Travel will not be held liable for any delays, cancellations, or issues arising from third-party suppliers that are beyond its control.
Travel Insurance
Klein Travel Strongly recommends that the Client purchase travel insurance to cover risks such as trip cancellations, medical emergencies, and other unforeseen events.
The Client acknowledges that they have been advised to purchase travel insurance and assumes all risks if they choose not to do so.
Documentation and Identification
The Client is responsible for obtaining all necessary travel documents, including passports and visas, and ensuring that they are up to date and valid for the duration of the trip. Renew your passport early. Passports must be valid for 6 months past the return date.
The Client must ensure that all travel documents match the legal names as they appear on their identification. Any discrepancies may result in denied boarding or other travel interruptions.
Health and Safety
The Client confirms that they are in good health and fit for travel. It is the Client's responsibility to consult with a healthcare provider if they have any concerns.
The Client acknowledges the risks associated with travel since the COVID-19 pandemic and other communicable diseases. The Client agrees to comply with all health and safety guidelines and waives liability against Klein Travel for any illness contracted during travel.
Assumption of Risk and Liability Waiver
The Client acknowledges that travel involves inherent risks, including but not limited to illness, injury, delays, and cancellations.
The Client agrees to waive any claims against Klein Travel for damages except in cases of gross negligence or willful misconduct.
Dispute Resolution
Any disputes arising from this Agreement will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration will take place in Gainesville, GA.
This Agreement will be governed by and construed in accordance with the laws of the State of Georgia.
Miscellaneous
Klein Travel reserves the right to modify these terms and conditions with notice to the Client. Any modifications will be effective upon the Clients receipt of such notice.
